1 Booking Contract: A binding contract between the comes into existence when confirmation of your rental is sent by SCI Petit Guemene on behalf of the property owner/or agent to the Client. The person who signs the Booking Contract is deemed to accept the booking conditions on behalf of all persons named on the booking contract, and agrees to keep all members of the party informed of all matters relating to their rental

2 Reservations: should be made in writing. The Owners will e-mail or mail you a booking form which should be completed and accompanied by a deposit of 30% of the total rent due. We recommend that you email first to double check availability. Once the deposit is RECEIVED, the Owners will send a confirmation invoice and statement. This is the final acceptance of the booking.

3 The balance of the rent is payable not less than eight weeks before the start of the holiday. If payment is not received by the due date the Owner reserves the right to give notice in writing that the booking is cancelled. The Client will have some remaining liabilities, as per the cancellation schedule, outlined below.

4 Payments should be a direct deposit to the bank details supplied to the guest.

5 Alterations to original booking (subject to availability) should be made in writing and will be subject to a £15/20€ administration charge. If alterations are made after six weeks but before your arrival and substitute guests can NOT be found, the Owners reserve the right to enforce the alteration/cancellation fees as detailed below.

6 Cancellation Policy: If you are compelled to cancel your rental in full or in part, you must inform SCI Petitions Guemene Immediately, and then confirm your cancellation in writing. You remain responsible for the total cancellation charges. A cancellation can only be accepted in writing, from the lead member of the party for whom the booking was made. The cancellation will only be effective from the date the letter is received.

Cancellation charges: from the date of receipt of the Client's cancellation letter: To receive a 100% refund, guests must cancel at least 30 days before check-in

• To receive 50% refund, guests must cancel between 14 and 30 days before check-in

• There will be NO REFUND if cancelled 14 days or less before check-in.

7 Cancellation by the Owners: if for any reason the Owners are obliged to cancel the Client's booking, all monies paid to date will be refunded in full. This is the limit of the Owners' liability.

8 Clients are advised to settle chargeable expenses locally with the owner/agent before departure from the rental property, including the replacement of any small breakages.

9 Extra Charges: Linen is included in most properties and will include sheets, pillowcases, bath towels and tea towels. Pool and beach towels are NOT provided. A heating surcharge will apply to rentals from the 1st November to mid March and will be noted on the Booking Confirmation sheet.

10 Security Deposit: Security deposits, required by property owners, cover costs of any loss, breakage or damage to the property or the contents during the clients' stay, including any chargeable expenses - additional cleaning costs, in the event that the property is left in an unacceptable condition. Security deposits will be held in cash, by the Petit Guemene housekeeper who will refund it immediately on inspection of the property, as the guests depart.

11 A security deposit of 150euros for every week or part week of the rental period is required in case of damage to the property or its contents. Security/damage deposits are refundable less any expenses due to damage.

12 Insurance Protection: It is strongly recommended that you cover both the booking deposit and the balance of payment with cancellation insurance. Both the deposit and the balance are non-refundable. Typically, insurance must be purchased at the time the deposit payment is made or within 48-72 hours from the date of the deposit payment, depending on the rules set by the insurer. Evidence of deposit payment may be required in order to purchase an insurance policy. For this reason, you are advised to keep a photocopy of your receipt and contract as well as the originals. Where possible, clients can arrange with their insurer a comprehensive travel insurance policy, including coverage for health, cancellation, personal belongings and personal and third party liability.

13 The Rental Period will start at 4.00PM on the day of arrival, and finish at 10.00AM on the last day. The changeover day is Saturday, unless otherwise stated.

14 Tenants Responsibilities:

◦ The client is responsible and is expected to take all reasonable care of the property.

◦ The client is responsible for leaving the property in a clean and tidy condition.

◦ The client is responsible to settle any chargeable expenses arising from the rental period with the owner or representative before departure.

◦ The client is totally responsible for any damage to the property, its contents, or to any Third Party visiting the property, which is caused by the contract holder, a member of the rental party, or any guests invited to the property by the rental party. Where the damage deposit does not cover the damage, the client will be held responsible for covering the additional damage costs.

◦ The client agrees that only the members of the party named on the contract are permitted to stay at the property during the rental period.

◦ Extra people will be charged at a rate to be agreed with the Owner. Infants and young children should be included when stating total numbers in your party.

◦ The client agrees not to act in any way that causes disturbance to neighbours.

◦ The client agrees to take all precautions to protect the property and contents against risks of theft, fire, explosion, water damage, electrical or gas disasters

◦ The Client shall report to the Owner without delay any defects of the Property, or any breakdown of equipment or appliances in the Property or garden, and arrangements for repair and/or replacement will be made as soon as possible.

◦ The properties will be professionally cleaned on your departure. However, the Client is responsible for leaving the house and its contents clean and tidy. This includes washing up, cleaning oven, dishwasher, microwave, barbecue, basin, baths/shower, WC, floors, bedding, returning all furniture to its original position. If, in the opinion of the Owners, the house has not been left in a satisfactorily condition, equivalent to the condition in which the Client moved in, the Owner reserves the right to make a deduction from the security deposit to cover additional heavy cleaning costs.

◦ Pets are not permitted without the explicit permission of the property Owner.

15. The Owners Responsibilities:

◦ To provide accommodation and furnishings according to the description of the property in good condition, working order and free from defects.

◦ To maintain the good condition and working order of the accommodation, facilities or appliances and to make arrangements for the repair or replacement of any defects.

◦ To refund the security deposit at the end of the rental period as stated in the Terms & Conditions, with the exception of any amounts retained for which the tenants are responsible.

◦ To carry valid insurance on the property which cover the usual risks for furnished property rentals.

◦ The Owner shall not be liable to the Client for any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, or appliance in the Property or garden, so affected. For any loss, damage, injury that is the result of adverse weather conditions, riot, war, strikes, or other matters beyond the control of the Owner. For any loss, damage or inconvenience caused to or suffered by the Client if the Property shall be destroyed or substantially damaged before the start of the rental period, and in any event, the Owner shall, within seven days of notification to the Client, refund all sums previously paid in respect of the rental period.

16.Complaints: In the unlikely event that you are dissatisfied, you must in the first instance contact the owner, key holder or supplier of the property. Complaints about the property must be notified by phone to the local representative/ housekeeper while the client is at the property. The client must allow the Owner or Key Holder the opportunity to remedy the problem. If, after doing so, the client still feels that the problem has not been resolved satisfactorily, then the complaint must be stated in writing within 28 days of the departure date in the contract. The local representative will forward any complaint to the Owner. SCI Petit Guemene will endeavour to resolve complaints in collaboration with the Owner or supplier. However, a resolution of the situation is at the sole discretion of the Owner or supplier.

◦ Failure to follow the complaint procedure will make it impossible for both SCI Petit Guemene and the supplier or the Owner to put the matter right. Accordingly, the Owner cannot accept any liability in relation to any complaint or claim, which is not notified entirely in accordance with this condition.

17. The role of SCI Petit Guemene:

◦ While SCI Petit Guemene makes every effort to ensure that each property suits client needs, SCI Petit Guemene acts only as an agent for the property owners or supplier.

◦ In all legal respects, tenants are directly responsible to the property owner, and the owner is directly responsible to the tenant.

◦ SCI Petit Guemene assumes no responsibility or liability for any claims, damages, expenses or other financial loss, whether to person or property, arising from injury, accident, death, delay, alteration, inconvenience, or other cause including airline scheduling. SCI Petit Guemene is not responsible in any way for any damage to the rental property caused by the rental party, and does not accept responsibility for the personal liability of the rental party.

18. Disclaimer: The Owner cannot accept any responsibility whatsoever for any injury or damage to Clients or any member of their party or any of their property whilst using the house or grounds. Under no circumstances shall the Owner's liability to the Client exceed the amount paid to the Owner for the rental period.

19. Acceptance of these Terms & Conditions: At the time of confirmation of the booking, the Client is deemed to agree to these Terms and Conditions and that the provision of the Booking Confirmation are in effect. Client signature on the Booking Contract and the Terms and Conditions form acknowledges that he/she and all members of his/her family or travelling party and their guests have agreed to the Booking Confirmation and the Terms and Conditions.

20. Party Leader: the person signing the booking form is deemed to be the party leader and is responsible for all members of his/her party adhering to these terms & conditions.

This contract shall be governed by French law in every way including interpretation, and shall be deemed to have been made in France. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in France.
